Jackpot Energy Shots Promotion
NO PURCHASE NECESSARY
GAME DESCRIPTION: The Jackpot Energy Shots Promotion (the "Game") will take place from January 15, 2012 at 12:00:01 a.m. Eastern Time (“ET”) through January 14, 2013 at 11:59:59 p.m. ET (the “Game Period”). Participation in the Game does not constitute participation and/or entry into any other promotion, contest or sweepstakes. By participating in the Game, each participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Jackpot Energy Beverages, Inc., 140 E. Ridgewood Ave., Paramus, NJ 07652 ("Sponsor"), which shall be final and binding in all respects.
ELIGIBILITY: Open only to legal U.S. residents who are eighteen (18) years of age or older. Officers, directors and employees of Sponsor, SCA Promotions, Inc., and each of their respective parent, subsidiary, and affiliated companies, distributors, sales representatives, retail accounts, advertising and promotion agencies (collectively, the “Promotion Entities”), and each of their immediate family members and/or those living in the same household of each, are ineligible to participate in the Game. Game is void where prohibited.
HOW IT WORKS:
- 1. Purchase Method: During the Game Period, purchase a specially marked 2 oz. Jackpot Energy Shot at a participating retailer, while supplies last. The Code will be printed on specially marked bottles of Jackpot Energy Shot. To see if you are a winner, go to www.myjackpotshot.com (the “Website”), complete the registration information requested and enter your Code as directed, and upon pressing "Submit", you will instantly receive a message notifying you whether or not you are a winner, subject to verification of eligibility. Each unique Code is eligible for only one (1) play attempt and may not be entered more than one (1) time. A confirmation e-mail will be sent to the winning participant at the e-mail address provided during the registration process. Your Code must be entered by 11:59:59 p.m. ET on November 30, 2012.
- 2. Free Method: To play without making a purchase, go to the Website and follow the on-screen instructions to play without making a purchase. If you are a winner, a confirmation e-mail will be sent to the winning participant at the e-mail address provided during the registration process.
All potential winners are subject to verification of eligibility and compliance with these Official Rules before any prize will be awarded. Limit one (1) Game play per person per day. For purposes of these Official Rules, a “day” is defined as any twenty-four (24) hour period beginning at 12:00:01 a.m. ET and ending at 11:59:59 p.m. ET.
If due to printing, production, technical or other errors, more prizes are claimed than intended, the intended prize(s) will be awarded in a random drawing from all those submitting purportedly valid claims. No more than the number of prizes set forth in these Official Rules will be awarded. Codes not legitimately obtained and/or used in accordance with these rules are void. Use of any automated system to participate is prohibited and will result in disqualification. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING. A "SCREEN SHOT" IS NOT PROOF OR EVIDENCE OF A WINNING GAME PLAY AND/OR PRIZE. A PARTICIPANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE WEBSITE SHOULD SO INDICATE, UNLESS AND UNTIL SAID PARTICIPANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAS BEEN VERIFIED AND SAID PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY PLAY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE PLAY AND IS VOID AND WILL NOT BE HONORED.
PRIZES/ ODDS: UNCLAIMED/UNREDEEMED PRIZES WILL NOT BE AWARDED.
One (1) Grand Prize is available. The Grand Prize consists of $1,000,000. The Grand Prize will be awarded in the form of an annuity paid out as $25,000 per year for 40 years. The odds of winning the Grand Prize are 1:125,000,000.
One (1) First Prize is available. The First Prize consists of $10,000 cash. The odds of winning the First Prize are 1:125,000,000.
One (1) Second Prize is available. The Second Prize consists of $5,000 cash. The odds of winning the Second Prize are 1:125,000,000.
General Prize Conditions. All costs and expenses incurred in connection with redeeming, accepting, or using a prize that are not specifically provided for herein, such as tax, gratuities, personal expenses, and any incidental expenses, are solely the responsibility of the applicable prize winner. Prizes not claimed in accordance with these Official Rules will not be awarded. All details and other restrictions of prizes not specified in these Official Rules will be determined by Sponsor in its sole discretion. The potential winners must execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release (collectively, "Prize Claim Documents") within (10) days of notification. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner. If any prize notification letter or prize is returned as undeliverable, winner may be disqualified. Each prize winner shall be solely responsible for any federal, state and/or local taxes incurred in claiming the prize. Prize winners will be issued a 1099 tax form following the awarding of the prize for the value of the prize.
GENERAL LIABILITY RELEASE. Acceptance of a prize constitutes winner’s permission for Sponsor and its designees to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants (or if minors, their parents or legal guardians) agree that the Promotion Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Game or any Game-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s or any other person’s computer system which is occasioned by accessing the Website or otherwise participating in the Game, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Game, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Game, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software generated or other automated multiple entries will be accepted. In the event Sponsor is prevented from awarding prizes or continuing with the Game as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Game. If the Game is terminated before the designated end date, any remaining prizes will not be awarded. These Official Rules cannot be modified or amended in any way except in a written document by a duly authorized representative of Sponsor. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE GAME SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF NEW JERSEY WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.
